Child Support Enforcement (CSE)

The Fulton County Attorney’s Office collaborates with the Cabinet for Health and Family Services to support non-custodial parents in meeting their financial responsibilities towards their children. This partnership aims to provide resources and assistance that help ensure that children receive the necessary financial support from both parents.

The Child Support Enforcement office provides a wide range of services including:

  • Establishing paternity

  • Setting and modifying child support obligations

  • Establishing Medical Support Orders

  • Monitoring child support payments

  • Enforcing child support orders

Fully processing a case through the court system can take several months.  Our office works closely with federal, state and local agencies, and private employers to obtain the required information to process cases and locate non-custodial parents as quickly as possible. You can help in this effort by providing and updating our office on the residence and employment of the non-custodial parent, and when the guardian or custodial parent’s contact information changes.

  • There are two ways to apply for child support in Kentucky.

    • Complete an application online using the Kentucky Child Support Website

    • Visit the Fulton County Child Support Enforcement Office at 203 E. Moulton Street, Hickman, KY 42050 and request an application

    Please note that child support may be initiated by the state of Kentucky if custodial parent is receiving state welfare benefits (K-TAP) or if referred from DCBS.

  • Anyone who has physical custody of a child and needs help establishing who is the father of the child, establishing a child support order, or collecting current or past-due child support payments is eligible to receive child support services.  Services are available to anyone living with and caring for a child who needs financial help supporting him or her. If you believe you may be the father of a child, you can apply for services to establish paternity and a child support order.

    Child support services are automatically available to current and former recipients of K-TAP and medical assistance.

    There are currently no fees associated with the application for these services.

    Child Support services deducts an annual fee of $35 from the custodial parents’ child support payments when:

    • He/she has never received KTAP or Kinship Care for the child(ren)

      AND

    • At least $550 in child support payments have been sent to the custodial parent during the federal fiscal year (October-September)

  • Complete an application for child support.

    Providing the non-custodial parent's address, social security number, date of birth, employer, bank account details, property ownership, and investments can be very helpful. You can find this information in old insurance policies, credit card applications, tax returns, hospital records, police reports, and birth certificates. You might also get details from the non-custodial parent's friends, family, or business contacts.

    Additionally, send copies of any court orders and payment records. If you know the non-custodial parent's date of birth and parents' names, the child support agency can get information from agencies like Social Security, IRS, Veterans Administration, and others. The agency can access all state and federal records if you provide the non-custodial parent's social security number. However, be prepared for this process to take several months.

  • County attorneys are contracted to provide legal services to and for the Commonwealth of Kentucky. They do not represent you or your personal interest.

     

  • The Kentucky Legislature has created a formula to determine child support. The formula takes into account each parent's income, medical insurance costs, daycare expenses, the number of days spent with the child(ren). and any child support already being paid for older children to calculate the total amount required.

    You may estimate your child support obligation online through the CSE website https://KentuckyChildSupport.ky.gov.

  • To obtain information about your child support case 24 hours a day, 7 days a week, sign up for online access to the CSE website at https://KentuckyChildSupport.ky.gov. From this website, you can communicate with your caseworker, check payments and balance owed, change your electronic deposit information, and provide updated employment and address information.

  • CSE requires custodial parents to receive their child support payments by electronic deposit to a checking or savings account or Kentucky Way2Go Card.

    If your account information changes you must submit a new CS-202 to notify our office of the change or update the information online through the Kentucky Child Support Interactive Website.

    Only brick and mortar (physical) banks are accepted. At this time, Chime cards are not eligible for bank transfer.

    Kentucky Way2Go Card - CSE provides the Kentucky Way2Go Card to receive child support payments. This MasterCard debit card from Comerica Bank offers a simple, convenient, and secure way to access child support without a bank account. It's ideal for those without a personal bank account or who want to separate these payments from their personal finances.

  • Child support can be changed if there is a significant change in circumstances, like a change in income or an older child becoming independent, resulting in at least a 15% change in the amount.

  • Please contact the child support office to file a modification at (270) 236-0100.

    To change child support, a motion must be filed with the original court. Only a signed order from a judge can alter child support. If both parents agree, they can sign an order with the judge. If there is no agreement, a court hearing is needed for the judge to decide.

    According to rules, the following individuals can request a review to possibly change the support amount:

    • The custodial parent

    • The noncustodial parent

    • A nonparental custodian (like a grandparent or aunt/uncle)

    • A foreign country with ties to Kentucky can also request a review, treated like a request from another state.

    Child support staff must inform both parties at least once every three years about their right to ask for a review and possible adjustment of the child support order.

  • CSE can use various methods, such as court action, income withholding, seizing bank accounts, suspending driver’s or professional licenses, intercepting lottery winnings, withholding state or federal tax refunds, and denying passport applications.

  • KRS 403.213(3) requires support payments to continue until the child emancipates (reaches the age of 18). If the child emancipates because of age, but not due to marriage, while still a high school student, the court-ordered support will continue while the child is a high school student, but not beyond completion of the school year during which the child reaches the age of 19. Child support may end sooner if the child emancipates because of marriage, induction into military service, death, or upon termination of parental rights.

  • Contact the Fulton County Attorney Child Support office caseworkers to request a copy of your payment history.

    You can also visit the Child Support Website to get a copy of payment history, court dates, arrears balances, and more.

  • Yes, all states must provide child support services regardless of where the other parent lives. The Uniform Interstate Family Support Act (UIFSA) requires states to work together to establish and enforce a child support order.

  • Child support payments are separate from visitation rights. CSE cannot provide services to address visitation or custody or establish or modify spousal support. If a court orders you to pay child support, you must pay it regardless of your visits with the children.

    If you have visitation rights but the custodial parent does not allow you to see the children, you may be able to file a motion with the court to have them held in contempt.

    If you do not have visitation/custody established with the court, you may be able to file a self-motion in the case and request a hearing for visitation/custody.

    Self motions can be filed at the Fulton Circuit Clerk’s Office (courthouse).

  • Electronic payments can be made on the Kentucky Child Support Interactive Website.

    Payments are accepted in the office and via mail by check or money order (no cash) with your name and case number and/or social security number as identifying information. For correct posting through mail, please address to:

To access information, you need your Individual Child Support ID Number from the agency. If you lose or forget this ID number, contact your local child support office for help.
